Outlook Amusements, Inc. (“Outlook”) values your trust and is committed to the responsible management, use and protection of your information. This Privacy Policy describes the types of information Outlook collects from you when you visit our web sites that link to this Privacy Policy, as an employee, job applicant, or independent contractor, and explains how Outlook may use and disclose such information. Outlook is the controller for purposes of any information processed for European Union data subjects.

NOTICE TO CALIFORNIA RESIDENTS 

Notice at Collection of Personal Information: We list the categories of personal information that we collect below under “Information You Provide.” We collect personal information about you for the purposes described below under “Use of Applicant Information.” For more information on your privacy rights, including how to opt out of the sale or sharing of your personal information, please see “Your California Privacy Rights” below.

What is the purpose of this Policy? 

This Privacy Policy provides applicants to any full- or part-time employee or independent contractor position with Outlook or any of its subsidiaries (“Applicant”) with information on how Outlook collects, uses, or otherwise shares data that Outlook processes during an Applicant’s application, hiring, or contracting process (“Applicant Information”).

Nothing contained in this Privacy Policy creates or is intended to create an employment contract between Outlook and any of its Applicants.

Does this Policy Apply to Me?

This Privacy Policy applies to all Applicant Information Outlook collects from you during your use of employment and contractor application forms, or other related functions, made available on the Sites. In order for Outlook to process your application, you will need to provide Applicant Information online. If you choose not to provide complete information, Outlook will not be able to process your application.

Legal Basis for Processing

Outlook will only process your Applicant Information where the company has a legal basis for doing so. Such processing is necessary to process your application with Outlook, including to consider your application, comply with legal requirements, to enable us to pursue our legitimate interest in operating our business, and to provide you with information about Outlook.

We will not process Applicant Information for purposes other than those listed in this section, unless we have a legal requirement to do so, or you have given us consent. We may continue processing your Applicant Information even after you have completed the application process, as necessary in connection with the legal bases identified in this section.

Information You Provide

This Privacy Policy covers any Applicant Information you submit through the Sites as part of the employment and/or contractor application and screening processes, including, but not limited to:

  • Identifiers: Information that identifies you directly.
    • Examples: Name and contact information (including address, telephone number, email address); username; login and password;
  • Employment and Education Information: Information about your employment history and education.
    • Examples: CV; résumé cover letter; and previous work experience and education information;
  • Other Work-Related Information: Information related to your application.
    • Examples: Work preferences; willingness to relocate; desired compensation; how you heard about the Sites; professional and other work-related license, permits, and certifications held; language and other relevant skills; information relating to references; awards and professional memberships; citizenship and eligibility to work in the country where the job applied for is located; and available start date.
  • Characteristics of Protected Classifications under California or federal: Information related to your gender and gender identity.
  • Internet or Other Electronic Network Activity Information: Some limited information about how you use the Internet.
    • Examples: Internet Protocol (IP) addresses; browser type; internet service provider (ISP); referring/exit pages; operating system; date/time stamp; clickstream data; unique device identifier; statistics related to where you visit and how you use the Sites; and domain name from which you accessed the Sites.

You also may voluntarily choose to provide other relevant Applicant Information as part of your application. Please do not submit any of the following sensitive information on the Sites: Social Security number, sexual orientation, race, ethnic origin, religion, beliefs, and/or disability.,

If you intend to provide us with details of a reference or any other third party as part of your CV/résumé, you must obtain consent from that third party prior to sharing the information with us.

You are responsible for the content of the Applicant Information you provide to us and you must ensure that it is legal, truthful, accurate and not misleading in any way. Such information must not infringe on any third party’s rights or be otherwise legally actionable by such third party.

Information from Third Parties

Outlook may use third-party vendors through which you can provide Applicant Information during the course of your application. If you are located in the European Union, this will require us to transfer your Applicant Information to the United States. For these transfers, Outlook has established agreements with such vendors to address safeguards using standard contractual clauses. You may obtain a copy of these standard contractual clauses by emailing privacy@outlookamusements.com.

Use of Applicant Information

Outlook will collect, use, transfer, and disclose Applicant Information that you provide through the Sites for Outlook’s recruitment functions and for related management and planning purposes. Outlook will use the Applicant Information you provide, as permitted by applicable law, to:

  • process your application;
  • assess your capabilities and qualifications for a position;
  • provide to you any services available on the Sites from time to time;
  • communicate with you;
  • comply with any applicable law or regulation;
  • prepare internal reports and metrics;
  • monitor and record services whether provided by Outlook or a third party (including IT and communications systems, along with any message, files, data, document, facsimile, audio/video, social media post or instant message communications, or any other types of information transmitted to, through or from, received or printed from, or created, stored or recorded on such IT and communications systems and assets); and
  • conduct background checks, conduct reference checks and/or verify employment history if you are offered a position.

Outlook will add your Applicant Information to its candidate database and will use such Applicant Information to consider whether your profile is suitable for other job vacancies at Outlook. If we elect to make you an offer, we may incorporate Applicant Information you submit into our systems and use such Applicant Information to manage the new-hire process. If you become an employee, any Applicant Information that you have submitted may become part of your employee file and Outlook may use such Applicant Information for other employment or work-related purposes.

Providing Applicant Information on the Sites is voluntary. Please note, however, that failure to provide sufficient Applicant Information may result in Outlook being unable to consider, or rejecting, your application.

Information Automatically Collected

Outlook uses technologies such as cookies, web beacons, pixel tags, scripts, log files, or local shared objects (Flash cookies/HTML5), along with its advertising partners, marketing affiliates, and analytics providers, to collect Online Activity about visitors to our Sites and Site interactions.

Our advertising partners, marketing affiliates, and analytics providers may also share reports that include information they have collected using these technologies on an individual as well as aggregated basis. We use this information to analyze trends, to administer the Sites, to track users’ movements around the Sites, and to gather demographic information about our user base as a whole.

Disclosure of Information

We will share or disclose the Applicant Information we collect from and about you with third parties only in the ways we describe in this Privacy Policy. We do not sell your Applicant Information to unaffiliated third parties. Outlook employees or agents who have a business need to access such information will review your Applicant Information. This may include recruiters, human resources personnel, technical services personnel, and managers or their designees.

We may share Applicant Information about you with selected service providers or consultants acting on our behalf and with whom we contract to carry out business, professional or technical support functions for us. We contractually require that our service providers 1) protect the privacy of your Applicant Information consistent with this Privacy Policy, and 2) will not use or disclose your Applicant Information for any purpose other than providing us with products and services, except as required by law.

Outlook also may disclose Applicant Information about you in order to: (1) protect the legal rights, privacy or safety of Outlook, its Applicants, or agents; (2) protect the safety and security of visitors to, or users of, our web sites or other properties; (3) protect against fraud or other illegal activity or for risk management purposes; (4) respond to inquiries or requests from government or public authorities; (5) pursue available remedies or limit the damages that we may sustain; (6) enforce our Terms of Use; or (7) comply with the law or legal process.

Outlook also may transfer any and all Applicant Information that we collect about you to third parties in the event of any merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Outlook’s assets or stock (including without limitation in connection with any bankruptcy or similar proceedings). Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use the information provided through the Sites in a manner that is consistent with this Privacy Policy.

Outlook may also share aggregate or anonymous non-personal information with third parties, including affiliated companies and non-affiliated companies, for their marketing or analytics uses.

Data Retention

We are required to retain certain Applicant Information relating to candidates applying for jobs within the United States. If there is no activity in relation to the Applicant Information, Outlook may remove it from its database, subject to Outlook’s data retention policies and practices and any applicable legal or regulatory obligations. Note that Outlook may delete Applicant Information it processes about you at any time (including your CV/résumé), for any or no reason and without notice to you. Therefore, please retain your own copy of the Applicant Information you provide to us.

Security

We take reasonable precautions to safeguard the information transmitted between visitors and the Sites and the information stored on our servers. Unfortunately, no method of transmitting or storing data is guaranteed to be 100% secure. Therefore, we cannot guarantee your Applicant Information’s absolute security. Please do not send sensitive information via email. It is your sole responsibility to use the appropriate level of care whenever communicating with us.

If you have reason to believe that your interaction with us is no longer secure (for example, you feel that the security of any account you have with us has been compromised), you must immediately notify us of the problem by contacting us at privacy@outlookamusements.com

Links to other websites

The Sites may contain links to other websites. The operators of those other websites may collect information about you, through cookies or other technologies. If you link to another website, you will leave the Sites and this Privacy Policy will not apply to your use of and activity on those other sites.

If you provide information through any other site, your transaction will occur on that website (and not the Outlook Sites) and that website operator will collect the information you provide. That site’s privacy policy will control the processing of your information. The Sites provide links to other websites only as a convenience, and including the links does not imply Outlook’s endorsement of the linked site. We encourage you to read the legal notices posted on those sites, including their privacy policies. We have no responsibility or liability for your visitation to, and the data collection and use practices of, other sites.

Your California Privacy Rights

Under California privacy law, when information identifies or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household, we refer to it as “personal information.”

If you are a California resident, you can take advantage of the following privacy rights:

  • Right to Know: You have the right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.
  • Right to Delete: You may request that we delete the personal information that we have collected from or about you. Note that there are some reasons when we will not be able to fully address your request, such as to perform a contract, to detect and protect against fraudulent and illegal activity, to maintain for internal purposes, to comply with a legal obligation or to preserve or exercise our rights.
  • Right to Correct: You have the right to correct inaccurate personal information that we may maintain about you, subject to appropriate verification.
  • Right to Opt-Out of the Sale or Sharing of Personal Information: You have the right to opt-out of the “sale” or “sharing” of your personal information, as such terms are defined under California privacy law. This means that, if you opt out, going forward, we will not sell or share your personal information with such third parties to use for their purposes, including cross-context behavioral advertising, unless you later direct us to do so. Notwithstanding the foregoing, we do not “sell” or “share” your personal information, as such terms are defined under California privacy law.

How to Submit a Request

To take advantage of your right to know, delete, or correct, please contact us by email at privacy@outlookamusements.com, or by mail at 3746 Foothill Blvd., #1119, Glendale, California, 91214. We may request certain information about your interactions with Outlook to verify your identity before we can respond to your access, deletion, or correction requests. Outlook will confirm receipt of your request within 10 business days and will respond to your request within 45 calendar days, after proper verification, unless we need additional time, in which case we will let you know.

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using your personal information, or any information collected from or about you, for any purpose other than to fulfil your requests, for verification, or for fraud prevention.

We value your privacy and will not discriminate in response to your exercise of your privacy rights.

In the last 12 months, Outlook has not sold or shared personal information.

We do not knowingly sell or share personal information about persons under the age of 16.

In the last 12 months, Outlook has disclosed the following categories of personal information for a business purpose (such as with our service providers or processors, whose use of personal information we disclose is limited to providing certain service to us pursuant to a written contract) to support the purposes for which we use personal information described above under “Use of Applicant Information”:

For European Union Residents

If you are a resident of the European Union and you are applying for a position with Outlook, you have additional rights related to your Applicant Information. These include:

  • The right to request a copy of your Applicant Information that we hold about you;
  • The right to request that we correct any of your Applicant Information if it is found to be inaccurate or out of date;
  • The right to request that your Applicant Information is erased when it is no longer necessary for us to retain such data;
  • The right, where there is a dispute in relation to the accuracy or processing of your Applicant Information, to request a restriction placed on further processing;
  • The right to withdraw consent where given prior to collection or processing of your Applicant Information;
  • The right to object to the processing of your Applicant Information; and
  • The right to lodge a complaint to the Information Commissioners’ Office if you believe that we have not complied with the requirements of the GDPR with regard to your Applicant Information.

In order to make one of the above requests, please contact Outlook using the information in the “Contact Us” section below. There may be times when we cannot comply with one or more of the above requests based on certain exceptions under the law. If we decline your request, we will provide you with a reason for the denial.

Changes to the Privacy Policy

We reserve the right, at our sole discretion, to change, modify, add, remove, or otherwise amend portions of this Privacy Policy at any time. When we do, we will post the revised Privacy Policy on the Sites or announce the change on the home page of the Sites before the change becomes effective. If we change the Privacy Policy in a material way, we will provide appropriate notice to you. If we post changes to this Privacy Policy and you choose to continue to use the Sites, that means that you accept the changes. If you do not agree with the terms of this Privacy Policy, in whole or part, you can choose not to continue to use the Sites.
